Article 1 (Scope of this Agreement)
Article 2 (Customers and Account Holders)
Article 3 (Account Registration)
a) Customers who purchase products using Our Services are required to create an account in advance. Account registration is free of charge.
c) Ichigo Estate reserves the right to decline a customer's registration if any of the following applies.
2. In the event that it is found that the membership registration application contains false information;
3. In the event that it has been found that there has been a delay in payment of fees, refusal or inability to collect products over a long period of time, refusal of returns or exchanges, or any other breach of duty without justifiable reason with respect to the services provided by Ichigo Estate in the past;
5. In the event that the applicant is an antisocial force (an organized crime group; a member of an organized crime group; a company, organization, or individual affiliated with an organized crime group; an extortionist or any other antisocial force); and
6. In any other cases where Ichigo Estate reasonably determines that approving the account registration is inappropriate for the provision and management of Our Services.
d) In the event of any changes to the registered information, account holders shall promptly register the changes in accordance with the method prescribed by Ichigo Estate. Ichigo Estate shall not be held responsible for any damages incurred as a result of changes in account information not being reflected by the account holder.
Article 4 (Management of Account IDs and Passwords)
a) It is the responsibility of the account holder to manage and protect their account IDs and passwords, and shall not be transferred or loaned to any third party. In addition, any manifestation of intent made to Ichigo Estate using an account ID/password shall be deemed a valid manifestation of intent by the account holder associated with the account ID/password.
b) Account holders shall be responsible for any damages caused by insufficient management of their account ID or password, errors during use, or unauthorized use by a third party.
Article 5 (Suspension of Use or Cancellation of Account Registration)
a) Ichigo Estate may suspend an account holder’s use of Our Services or cancel their registration without their consent if it is determined that any of the following applies to the account holder.
2. When it is found that there has been fraud or default in the use of Our Services in the past;
3. In the event that the registered information is found to contain false information;
4. In the event that any of the items in Article 3 c) are found to apply; and
5. In the event that any other inappropriate reasons for account registration are found.
Article 6 (Closing Accounts)
If an account holder wishes to close their account, please contact the e-mail address listed in Article 21 (Contact Information).
Article 7 (Product Purchases)
a) If an account holder wishes to purchase a product, the account holder shall enter the required information for the order, confirm the contents, and click the "Place Order" button to place the order. The order shall be confirmed upon shipment of the product from Ichigo Estate. If Ichigo Estate is unable to ship a product due to it being sold out, out of stock, or no longer being handled, Ichigo Estate will notify the account holder by phone or email.
b) Notwithstanding the provisions of the preceding paragraph, in the event of fraudulent or inappropriate behavior in relation to the use of Our Services, Ichigo Estate shall be able to take necessary measures, including cancellation and termination of the sales contract with the account holder.
c) Delivery of products under Our Services is available in Japan and overseas. For more information on product delivery, please refer to Shipping and Delivery.
d) In the event that a minor wishes to purchase a product, the account holder shall do so only with the consent of a legal representative such as a parent or guardian.
Article 8 (Payments)
a) The sales price shall be displayed for each product and does not include tax.
b) Shipping costs shall be displayed for each product.
c) Payments will be processed via registered credit cards (VISA, Mastercard, American Express), Shop Pay (credit card only), Apple Pay (credit card only), or Google Pay.
d) The timing of payments will depend on the contract details and expiration date of the credit card used or registered to Shop Pay, Apple Pay, or Google Pay. Please contact your credit card company for details.
Article 9 (Cancelations, Refunds, and Exchanges)
a) After an order has been processed, orders may only be cancelled for products that have not yet been shipped. After the products have been shipped, an order may not be canceled unless there is a reason attributable to Ichigo Estate.
b) We are unable to process returns or exchanges unless the product is defective.
1. Once you have receive the product, please check immediately to make sure that there are no defective parts or that you have not received a different product. We do not accept returns or exchanges of products more than seven days after the delivery date.
2. For returns and exchanges, please contact us at the email address listed in Article 21 (Contact Information).
3. If the product received differs from what was ordered, please be sure to contact us with the color, size, and other details of the product.
Article 10 (Customer Responsibility)
Customers are solely responsible for actions taken and any potential consequences when using Our Services.
Article 11 (Prohibited Actions)
Customers are prohibited from engaging in any of the following actions. In the event that damages are caused to Ichigo Estate or a third party as a result of any of these actions, customers shall be liable for the associated compensation.
a) Unauthorized use of account IDs or passwords;
b) Transferring or lending account IDs or passwords to a third party;
c) Registering false information;
d) Any action that interferes with the operation of Our Services, such as accessing this website and falsifying information or sending harmful computer programs to this website, or any other actions that may interfere with Our Services;
e) Infringing the trademark rights, copyrights, privacy, or other rights of other customers, third parties, or Ichigo Estate, or causing or threatening to cause trouble, disadvantage, or damage to other customers, third parties, or Ichigo Estate.
f) Using Our Services for commercial purposes (unless approved in advance by Ichigo Estate);
g) Actions that violate public order, morality, and laws; and
Article 12 (Ichigo Estate’s Disclaimer)
a) Our Services are provided by Ichigo Estate on an "as is" and "as available" basis, and Ichigo Estate does not warrant, expressly or implicitly, that Our Services will be compatible with a customer's specific purpose or have the expected functionality, commercial value, usefulness, accuracy, etc.
b) Ichigo Estate shall not be liable for any losses or damages arising from the use of Our Services, unless such losses or damages are attributable to Ichigo Estate.
c) Ichigo Estate shall be able to change Our Services without notice at its discretion, and shall not be liable for any resulting damages to the extent permitted by law.
e) In the event that the delivery address is unknown or a package cannot be delivered, Ichigo Estate shall be exempt from liability by delivering the product to the address specified at the time of the order or by using the registered information to contact the customer.
f) If Ichigo Estate is liable to the customer for any reason regarding the use of Our Services, Ichigo Estate shall compensate the customer for ordinary damages directly and actually suffered by the customer up to the total amount actually paid by the customer to Ichigo Estate during the most recent six months prior to the occurrence of such damages (however, this shall not apply in the case of intentional or gross negligence on our part), and shall not be liable for compensation in relation to incidental damages, indirect damages, consequential damages, or lost profits.
Article 13 (Suspension/Discontinuation of Our Services)
Ichigo Estate reserves the right to suspend or discontinue Our Services in whole or in part without prior notice to customers under any of the following cases. Ichigo Estate shall not be liable for any damages caused by such suspension or discontinuation to the extent permitted by law.
a) For website system maintenance;
b) If operating the website system becomes difficult;
c) In the event that the provision of Our Services becomes difficult due to a natural disaster such as a fire, earthquake, power outage, epidemic, or other force majeure; and
d) If Ichigo Estate judges that it is difficult to continue providing Our Services due to other unavoidable reasons.
Article 14 (Handling of Personal Information)

a) The intellectual property rights of the contents provided through Our Services shall belong exclusively to Ichigo Estate or the owner of the copyright of the contents. The customer shall not use or reprint these works without the permission of Ichigo Estate.
b) Regardless of the purpose, Ichigo Estate shall take immediate legal action when any act prohibited by domestic or foreign copyright or other laws, such as unauthorized duplication, unauthorized reproduction, or other unauthorized secondary use of Ichigo Estate's contents, is discovered.
c) In the event that a dispute arises with a third party due to a violation of the provisions of this Article, the account holder is responsible for resolving such dispute at its own expense, and shall not cause any damage, loss, or disadvantage to Ichigo Estate.
Article 16 (Assignment of Contract, etc.)
a) You may not assign, transfer, encumber, or otherwise dispose of your contractual position, rights, or obligations regarding the use of Our Services to a third party without the prior written consent of Ichigo Estate.
b) Ichigo Estate may transfer the business related to Our Services, and may transfer the contractual position, rights, and obligations related to Our Services to the assignee of the business, etc., and the customer shall agree to such transfer, etc. in advance.

1. Japanese Law shall apply to the establishment, effect, fulfilment, and interpretation of these regulations.
